Federal Greenhouse Gas Reporting Requirements
Under Congressional mandate, the U.S. Environmental Protection Agency (EPA) was called to “develop and publish a draft rule… to require mandatory reporting of greenhouse gas (GHG) emissions above appropriate thresholds in all sectors of the economy of the United States.” In response, the EPA published its Proposed Mandatory Greenhouse Gas Reporting Rule in April, 2009. The goal of the proposed rule is to collect annual GHG emissions data from the nation’s largest emitters, which span a wide range of industries. Below, are details of the five key reporting criteria that the EPA has established.
1. Facilities containing any of the following in their operations:
- Electricity generation units1
- Adipic acid production
- Aluminum production
- Ammonia production
- Cement production
- Semiconductor manufacturing1
- MEMS manufacturing1
- LCD manufacturing1
- Electric power systems1
- HCFC-22 production
- HFC-23 destruction1
- Lime manufacturing
- Nitric acid production
- Petrochemical production
- Phosphoric acid production
- Silicon carbide production
- Soda ash production
- Titanium dioxide production
- Underground coal mines1
- Municipal landfills1
- Manure management systems1
2. Facilities emitting 25,000 metric tonnes CO2e (mt CO2e) or more per year in combined emissions
from any of the following:
- Stationary fuel combustion units
- Miscellaneous use of carbonates
- Electricity generation
- Electronics – photovoltaic manufacturing
- Ethanol production
- Ferroalloy production
- Fluorinated greenhouse gas production
- Food processing
- Glass production
- Hydrogen production
- Iron and steel production
- Lead production
- Magnesium production
- Oil and natural gas systems
- Pulp and paper manufacturing
- Zinc production
- Industrial landfills
- Wastewater
3. Any facility meeting all of the following three conditions:
- The facility does not meet the above two criteria
- The aggregate maximum rated heat input capacity of stationary fuel combustion units is 30 mmBtu/hr or greater
- The facility emits 25,000 mt CO2e or more annually from all stationary fuel
combustion sources
4. Any supplier of any of the following products:
- Coal
- Coal-based liquid fuels
- Petroleum products
- Natural gas and NGLs
- Industrial GHGs1
- CO21
5. Manufacturers of the following mobile sources and engines1, 2:
- Passenger cars, light trucks, and medium-duty passenger vehicles
- Highway heavy-duty engines and complete vehicles
- Nonroad diesel engines and nonroad large spark-ignition engines
- Nonroad small spark-ignition engines, marine spark-ignition engines, personal watercraft, highway motorcycles, and recreational engines and vehicles
- Locomotive and marine diesel engines
- Jet and turboprop aircraft engines
