Climate Change Impacts Trigger EIS on
Light Truck Fuel Economy Standards
Nov. 19, 2007 -- On November 15, 2007, the Ninth Circuit Court of Appeals overturned NHTSA adoption of fuel economy standards for light trucks in part because the NHTSA EA did not adequately assess climate change impacts (CBD v. NHTSA (2007) 07 CDOS 130777). The court ordered NHTSA to prepare an EIS to fully assess the incremental and cumulative impacts of the proposed new fuel economy standards--which required only slight increases in light truck fuel economy--on greenhouse gas emissions and climate change. The court also required the EIS to consider alternatives that would greatly increase fuel economy, ruling that NHTSA has the authority to adopt such standards.
